"Response to Fox 5 News Dale Russell Story on Hold'em Tournaments"
It is my view that the Texas Hold'em tournaments that I am aware of in Georgia are permitted under Georgia law. A specific exemption in Georgia law allows for the conductiong of these tournaments under O.C.G.A. 16-12-20(1)(B).
A Texas Hold'em tournament is no different from a bridge tournament, golf tournament or pool tournament, that occurs throughout the state on a regular basis. The players compete, but do not bet, against each other and pay an entry fee or make a voluntary donation to enter such a tournament. In some cases, some of the participants do not pay any fee to participate in the tournament. Such tournaments are bona fide contests to determine the skill, speed, strength or endurance of the participant.
In the case of Texas Hold'em tournaments, I am aware of over one hundred publications that provide strategy to help improve a player's skill level in the playing and participating in a Texas Hold'em tournament. Obviously, through television, newspaper and the internet, the competition of Texas Hold'em tournaments has captured a wide audience of spectators and participants.
Many times in Georgia, Texas Hold'em tournaments are used to raise money for many worthy charities which benefit children and other individuals who are in need of help and assistance.
For anyone, including the media, to try and paint such a competition as illegal, improper, immoral or harmful, is a crude attempt to demonize a harmless, legal and enjoyable activity. It is hoped that responsible journalism will trump any reporters who wish to take such a cheap shot.
The Texas Hold'em tournaments in Georgia of which I am aware comply with existing law. They are a competitive and entertaining activity which often makes important and critical charitable contributions. I fact, contary to assertions of Mr.
Russell, members of law enforcement are doing their job in distinguishing between lawful Texas Hold'em tournaments and illegal gambling activities.
